Michael Batson is a shareholder at Hermes, Netburn, O'Connor & Spearing, P.C. Michael concentrates his practice in the areas of civil, commercial and class action litigation, construction law, insurance coverage and defense, environmental law, complex tort and product liability law. Michael has more than a decade of experience representing insurers and policy holders, individuals and corporations in complex litigation matters.
Michael represents clients in connection with claims for coverage on general liability, property, professional liability, directors and officers liability, umbrella and excess policies, and fidelity and surety bonds. Michael regularly represents owners, general contractors and subcontractors in construction-related litigation, including breach of contract claims and claims involving defective workmanship, personal injury and wrongful death. Michael’s broad background also includes handling matters involving defamation claims, non-construction-related breach of contract claims, stockholder disputes, fraud claims, bad faith claims, building leaks and violations of the Telephone Consumer Protection Act.

OneBeacon America Ins. Co. v. Haffner’s Service Stations
Summary judgment obtained and affirmed by Massachusetts Appeals Court for insurer on grounds that automobile insurance policy did not cover oil discharge resulting from negligent repair services.
OneBeacon America Ins. Co. v. Travelers Indem. Co. of Ill
Secured First Circuit decision reversing the District Court and ordering that summary judgment be entered in favor of OneBeacon providing for reformation of an insurance policy.

Attained favorable settlement for sand and gravel business for claims relating to the alleged release of sediment and hazardous materials.
